This Terms and Conditions agreement sets forth the agreement between Vancouver Island Naturopathic Store and/or the Vancouver Island Naturopathic Clinic Inc.  herein("VINS or VINC Inc." or "we" or “us”) and each user herein ("you" or "user" or “customer”) governing the use of this site.

By choosing to access and/or use this website, you, the user, agree to the following terms and conditions as set out here. These terms and conditions may be altered or changed at discretion of VINS or VINC Inc. at any time, and without further notice to the user. All orders, emails, purchases and any other business arising through this site are subject to these terms and conditions. Use of and orders placed on this website are subject and are governed by the laws of British Columbia and Canada and are governed by courts of the province of British Columbia, You, the user, are responsible for complying with these laws. Vancouver Island Naturopathic Store and/or the Vancouver Island Naturopathic Clinic Inc. affiliates, or any of their officers, directors, or employees, agents, third-party content providers, suppliers, or licensors reserve the right to report to law enforcement agencies any activities we deem to be unlawful.

This website should be accessed and used solely at your own risk. Though we make reasonable attempts to ensure the site is up to date and error free, we make no guarantees that the  content will be free of errors, accurate, complete or up to date at all or any times. If we discover a mistake, we will attempt to correct it as soon as possible and make every reasonable effort to notify any affected users. This may mean that orders not yet shipped may need to be cancelled. If we have listed at an incorrect price, we reserve the right to refuse or cancel any orders placed for product listed at the incorrect price and we may refuse or cancel any such orders at our discretion even if the order has been confirmed and payment made. If payment has already been made for the purchase and your order is cancelled, we shall issue you a credit in the amount of the incorrect price. Limitation of Liability

We shall not be held liable for any damages that result from the use of our website, or estore, or of the materials on our website or the performance of the products. Applicable laws may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you or your situation.

Vancouver Island Naturopathic Store and/or the Vancouver Island Naturopathic Clinic Inc. is not responsible for lost, illegible, misdirected or stolen messages or mail, unavailable connections, failed, incomplete, or delayed transmissions, online failures, hardware, software, or other technical malfunctions whether or not these circumstances affect, disrupt, or corrupt communications.

You agree to indemnify, defend, and hold the Vancouver Island Naturopathic Store and/or the Vancouver Island Naturopathic Clinic Inc., its officers, directors, employees, agents, licensors and suppliers from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account including negligent or wrongful conduct by you or any other person accessing the site using your Internet account or IP address.

The Vancouver Island Naturopathic Clinic Inc. / Vancouver Island Naturopathic Store fully cooperates with law enforcement agencies in identifying those who use our services for illegal activities, and may in its sole discretion disclose personal information or other information to satisfy any law, regulation, subpoena, or government request. We reserve the right to release personal information or other information about users who we believe are engaged in illegal activities or are otherwise in violation of our terms of use if we believe in our sole discretion that such disclosure is necessary or appropriate to operate the web site, or to protect our rights and property or the rights and property of our users / customers.

Sales Taxes

It is the responsibility of the user to pay for the amount of your invoice, including but not limited to shipping, additional fees (if applicable) and users in Canada must pay the current GST rate on all products and the current PST for the applicable Canadian province or Territory. *PST and GST rates may change at any time. You are responsible to pay the current GST rate in Canada at the time of order and payment and the current PST rate in your province at the time of order and payment.
Canadian Aboriginal Orders - Orders placed by Canadian Aboriginals are sales tax exempt, with the inclusion of a current and valid Aboriginal status number which must be provided at the time of the order.
International Order - Orders placed and shipped outside of Canada are exempt from Canadian and Provincial sales tax. Vancouver Island Naturopathic Store and/or the Vancouver Island Naturopathic Clinic Inc. are not responsible for additional tariffs, shipping fees or taxes that apply to items shipped outside of Canada. All of the advertised prices with-in this website are in Canadian dollars only.

Shipping

All prices on the website are in Canadian dollars and all charges will be processed in Canadian dollars. You agree to pay all charges payable for your order. If you place an order for shipment to an international address, you will be responsible for paying any value added taxes and other taxes, tariffs, import or export duties, and other similar fees imposed on such orders. These taxes, duties and fees are the sole responsibility of the package recipient, who will be billed for them by the local Customs office. International shipment rates may vary based on package weight and distance to final destination. Pricing on the website does not include duties, insurance costs, tariffs, or value-added taxes. All prices are in Canadian dollars only.
We will use commercially available reasonable efforts to deliver your ordered items to you as quickly as possible, and within any time indicated. We are not responsible for any delays beyond our control. We will make every effort to notify you the user if delivery is delayed for any reason. All purchases are delivered by a third party, and delivery is governed by their own shipping contracts.
Backorders

In the event that any items ordered are not available at the time your order is shipped, you will be contacted by phone or email to determine whether you wish we hold your order until the backorder is received or whether to ship you the partial order immediately and then either cancel your backorder or send if it is received within 30 days of your original order. Shipping fees will be applied and charged for back orders under $150. You will only be billed for the items shipped.

Changing an Order

Once an order has entered our system, the order may not be changed, or added to once they have been processed. Changes to an order, after an order has been placed may be requested, but there is no guarantee that they can or will be implemented.

Cancelling an Order

You may cancel your order if you fax or email us before your order is processed only at 1-250-881-1846 or reception@islandnaturopathic.com

Return Policy

Unopened and undamaged items only may be returned within 60 days of purchase, in their original condition and packaging with the original receipt for a full refund or store credit, excluding shipping charges. You the user are fully responsible for shipping charges back to our location for return purposes. Items that have been opened or damaged are not returnable. If the product to be returned was sent due to our error, we will refund the product and any shipping charges.  Please note that we cannot be responsible for returns that are lost or misdirected in shipping.  We are able to credit you for items only once we have received them, either to the same credit card, as store credit, or as an exchange.  Additional shipping costs will apply to all exchanges sent out unless it was due to an error on our part. Exchanged items will be subject to a 15% re-stocking fee.
